4. Data Collection on This Website

Cookies

Our website uses so-called “cookies.” Cookies are small data packets and do not cause any damage to your end device. They are stored either temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your end device. Session cookies are automatically deleted after your visit ends. Persistent cookies remain stored on your end device until you delete them yourself or an automatic deletion occurs by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g., cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary because certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies that are necessary for carrying out the electronic communication process, for providing certain functions you desire (e.g., for the shopping cart function), or for optimizing the website (e.g., cookies for measuring web audience) (necessary cookies) are stored on the basis of Art. 6 Para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent for the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 Para. 1 lit. a GDPR and § 25 Para. 1 TDDDG); consent can be revoked at any time.

You can configure your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or generally, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

If further cookies and services are used on this website, you can find this in this Privacy Policy.

Consent with Borlabs Cookie

Our website uses Borlabs Cookie’s consent technology to obtain your consent for storing certain cookies in your browser or for using certain technologies and to document this in compliance with data protection regulations. The provider of this technology is Borlabs GmbH, Hamburger Str. 11, 22083 Hamburg (hereinafter Borlabs).

When you enter our website, a Borlabs cookie is stored in your browser, which stores the consents you have given or the revocation of these consents. This data is not passed on to the provider of Borlabs Cookie.

The Borlabs Cookie has a validity of 60 days; after this period, the consent request will be displayed again. Additionally, Borlabs Cookie logs your consent or its revocation for verification purposes in our website’s database (anonymous identifier, version of the request, selection of services, time; no IP address). The collected data is stored until you request its deletion or the purpose for data storage ceases to apply. Mandatory legal retention periods remain unaffected. Details on Borlabs Cookie’s data processing can be found at https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.

The use of Borlabs Cookie consent technology is for obtaining the legally required consents for the use of cookies. The legal basis for this is Art. 6 Para. 1 lit. c GDPR.

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The collection of this data is based on Art. 6 Para. 1 lit. f GDPR. The website operator has a legitimate interest in the technically error-free display and optimization of his website – for this purpose, server log files must be collected.

Contact Form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We will not share this data without your consent.

The processing of this data is based on Art. 6 Para. 1 lit. b GDPR, if your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of inquiries addressed to us (Art. 6 Para. 1 lit. f GDPR) or on your consent (Art. 6 Para. 1 lit. a GDPR) if this was requested; consent can be revoked at any time.

The data you enter in the contact form will remain with us until you request its deletion, revoke your consent for storage, or the purpose for data storage ceases to apply (e.g., after your inquiry has been processed). Mandatory legal provisions – especially retention periods – remain unaffected.

Inquiry by Email, Phone, or Fax

If you contact us by email, phone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request.

The data you send us via contact inquiries will remain with us until you request its deletion, revoke your consent for storage, or the purpose for data storage ceases to apply (e.g., after your request has been processed). Mandatory legal provisions – especially statutory retention periods – remain unaffected.

We use the Google Tag (gtag.js). The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The Google Tag is a script that allows us to integrate and control Google Analytics on our website. It is only loaded after you have given your consent via Borlabs Cookie. Your IP address is transmitted to Google and may also be transferred to Google’s parent company in the United States.

Processing is carried out on the basis of your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG. Consent can be revoked at any time.

The company is certified under the “EU-US Data Privacy Framework” (DPF). Further information on this can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics allows website operators to analyze the behavior of website visitors. The website operator receives various usage data, such as page views, duration of stay, operating systems used, and user origin. This data is assigned to a pseudonymous identifier associated with the website visitor’s respective end device.

Furthermore, with Google Analytics, we can measure, among other things, scroll depth and clicks on links. Google Analytics also uses various modeling approaches to supplement the collected data sets and employs machine learning technologies for data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google about the use of this website is usually transmitted to a Google server in the USA and stored there.

The use of this service is based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG. Consent can be revoked at any time. Google Analytics is only loaded after your consent via Borlabs Cookie; without consent, no measurement takes place.

Data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://business.safety.google/adscontrollerterms/sccs/.

We have set the data retention period for user and event-level data in Google Analytics to 14 months; after this, this data is automatically deleted. Aggregated reports are not affected by this.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA that aims to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF commits to adhering to these data protection standards. Further information on this can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

6. Plugins and Tools

YouTube (extended data protection mode)

This website embeds videos from the YouTube platform. The platform operator is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in extended data protection mode (domain youtube-nocookie.com). According to YouTube, in this mode, YouTube does not store any information about visitors to this website before they watch the video. Furthermore, the videos are not loaded directly when the page is accessed: initially, only a preview image from our own server is displayed. Only when you start the video by clicking on the preview image is a connection established to YouTube’s servers. This informs YouTube which of our pages you have visited. YouTube may also collect your IP address and other information about your end device and your usage and – if you are logged into your YouTube account – associate it with your personal profile. You can prevent this by logging out of your YouTube account before starting the video. In addition, YouTube may store cookies on your end device or use comparable recognition technologies (e.g., device fingerprinting) after a video starts.

The embedding of YouTube is done in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG, insofar as the consent includes the storage of cookies or access to information in the user’s end device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

Further information on the handling of user data can be found in YouTube’s privacy policy at: https://policies.google.com/privacy.

Google Fonts (local hosting)

This site uses so-called Google Fonts, provided by Google, for the uniform display of fonts. The Google Fonts are installed locally. A connection to Google servers does not take place.

Further information on Google Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

Google Maps

This site uses the map service Google Maps. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. With the help of this service, we can embed map material on our website.

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer. If Google Maps is activated, Google may use Google Fonts for the purpose of uniform display of fonts. When Google Maps is accessed, your browser loads the necessary web fonts into its browser cache to display texts and fonts correctly.

The use of Google Maps is in the interest of an appealing presentation of our online offers and easy findability of the locations we indicate on the website.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

More information on the handling of user data can be found in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

reCAPTCHA is intended to check whether data entry on this website (e.g., in a contact form) is performed by a human or by an automated program. For this purpose, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. reCAPTCHA is only loaded after you have given your consent via Borlabs Cookie; the analysis then begins on pages with forms. For analysis, reCAPTCHA evaluates various information (e.g., IP address, duration of stay of the website visitor on the website, or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

reCAPTCHA analyses run entirely in the background. Website visitors are not informed that an analysis is taking place. Without your consent, you cannot submit our forms; in this case, please contact us by email or phone.

In this context, Google acts as a pure data processor within the meaning of Art. 28 GDPR and will not use the data collected in this way for its own purposes. The tool is used on the basis of a data processing agreement (DPA) with Google.

The storage and analysis of data are based on your consent in accordance with Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG; consent can be revoked at any time. The purpose is to protect our web offerings from abusive automated espionage and SPAM.

Ninja Firewall

We have integrated Ninja Firewall on this website. The provider is NinTechNet Limited, Unit 1603, 16th Floor, The L. Plaza 367 – 375 Queen‘s Road Central Sheung Wan, Hong Kong (hereinafter Ninja Firewall).

Ninja Firewall serves to protect our website from unauthorized access or malicious cyberattacks. For this purpose, Ninja Firewall collects IP address, request, referrer, and time of page access. Ninja Firewall is integrated on our own servers and does not transmit any personal data to the tool provider or other third parties.

The use of Ninja Firewall is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its website as effectively as possible from cyberattacks.

7. Audio and Video Conferences

Data Processing

For communication with our customers, we use, among other things, online conference tools. The specific tools we use are listed below. If you communicate with us via video or audio conference over the Internet, your personal data will be collected and processed by us and the provider of the respective conference tool.

The conference tools collect all data that you provide/use to use the tools (email address and/or your phone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants, and other “context information” related to the communication process (metadata).

Furthermore, the tool provider processes all technical data required for handling online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.

If content is exchanged, uploaded, or otherwise provided within the tool, it will also be stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards, and other information shared during the use of the service.

Please note that we do not have full control over the data processing operations of the tools used. Our possibilities are largely determined by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the respective tools used, which we have listed below this text.

Purpose and Legal Bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 Para. 1 lit. b GDPR). Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR). If consent has been requested, the respective tools are used on the basis of this consent; consent can be revoked at any time with effect for the future.

Storage Duration

The data directly collected by us via the video and conference tools will be deleted from our systems as soon as you request us to delete it, revoke your consent for storage, or the purpose for data storage ceases to apply. Stored cookies remain on your end device until you delete them. Mandatory legal retention periods remain unaffected.

We have no influence on the storage period of your data that is stored by the operators of the conference tools for their own purposes. For details, please inquire directly with the operators of the conference tools.

We use the following conference tools:

Microsoft Teams

We have concluded a data processing agreement (DPA) for the use of the aforementioned service. This is a contract required by data protection law, which ensures that the provider processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.

8. Our Own Services

Handling of Applicant Data

We offer you the opportunity to apply to us (e.g., by email, post, or via an online application form). In the following, we inform you about the scope, purpose, and use of your personal data collected during the application process. We assure you that the collection, processing, and use of your data comply with applicable data protection law and all other legal provisions, and that your data will be treated with strict confidentiality.

Scope and Purpose of Data Collection

If you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes from job interviews, etc.) to the extent necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 Para. 1 lit. b GDPR (general contract initiation) and – if you have given consent – Art. 6 Para. 1 lit. a GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If the application is successful, the data you submitted will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6 Para. 1 lit. b GDPR for the purpose of carrying out the employment relationship.

As part of the application process, we may also conduct an internet search about you. This primarily includes Google Search, LinkedIn, and Xing. The legal basis for this type of processing is our legitimate interest in obtaining an overall impression of publicly available information about you in accordance with Art. 6 Para. 1 lit. f GDPR.

Data Retention Period

If we cannot make you a job offer, you reject a job offer, or withdraw your application, we reserve the right to retain the data you submitted for up to 6 months from the end of the application process (rejection or withdrawal of application) based on our legitimate interests (Art. 6 Para. 1 lit. f GDPR). Afterwards, the data will be deleted and physical application documents destroyed. The retention serves, in particular, as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period (e.g., due to a threatened or pending legal dispute), deletion will only take place when the purpose for further retention ceases to apply.

Longer retention may also occur if you have given corresponding consent (Art. 6 Para. 1 lit. a GDPR) or if legal retention obligations prevent deletion.

Our Social Media Presences

This Privacy Policy applies to the following social media presences

Data Processing by Social Networks

We maintain publicly accessible profiles on social networks. The specific social networks we use can be found below.

Social networks such as Facebook, X, etc., can generally analyze your user behavior extensively when you visit their website or a website with integrated social media content (e.g., like buttons or advertising banners). Visiting our social media presences triggers numerous data protection-relevant processing operations. Specifically:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, data collection occurs, for example, via cookies stored on your device or by collecting your IP address.

With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. This allows interest-based advertising to be displayed to you within and outside the respective social media presence. If you have an account with the respective social network, interest-based advertising can be displayed on all devices on which you are or were logged in.

Please also note that we cannot track all processing operations on social media portals. Depending on the provider, additional processing operations may be carried out by the operators of the social media portals. For details, please refer to the terms of use and privacy policies of the respective social media portals.

Legal Basis

Our social media presence is intended to ensure the broadest possible presence on the Internet. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR. The analysis processes initiated by the social networks may be based on different legal bases to be specified by the operators of the social networks (e.g., consent within the meaning of Art. 6(1)(a) GDPR).

Controller and Assertion of Rights

When you visit one of our social media pages (e.g., Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered by this visit. In principle, you can assert your rights (information, correction, deletion, restriction of processing, data portability, and complaint) both against us and against the operator of the respective social media portal (e.g., against Facebook).

Please note that despite the joint responsibility with the social media portal operators, we do not have full influence over the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

Storage Duration

The data collected directly by us via the social media presence will be deleted from our systems as soon as you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal provisions – in particular retention periods – remain unaffected.

We have no influence on the storage duration of your data, which is stored by the operators of the social networks for their own purposes. For details, please inform yourself directly from the operators of the social networks (e.g., in their privacy policy, see below).

Your Rights

You have the right to receive information about the origin, recipient, and purpose of your stored personal data at any time free of charge. You also have a right to object, to data portability, and a right to lodge a complaint with the competent supervisory authority. Furthermore, you can request the correction, blocking, deletion, and, under certain circumstances, the restriction of the processing of your personal data.
